Terms of Use and End User License Agreement

Time Limit · effective 22 October 2026 · version 1.0

This document is both the Terms of Use and the End User License Agreement ("EULA") for the Game. Section 11 contains the terms Apple requires in a custom EULA; if you prefer to rely on Apple's standard EULA instead, point the Terms of Use link in the app at apple.com/legal/internet-services/itunes/dev/stdeula and leave the License Agreement field in App Store Connect empty.

1. The agreement

These terms are an agreement between you and James Kaguo, P.O. Box 1802, Dodoma, Tanzania ("we", "us"), about the Time Limit mobile game, its updates and this website (together, the "Game"). By installing or playing the Game you accept these terms and our Privacy Policy. If you do not accept them, do not install or play the Game.

You must be at least 13 years old to play (or older if your country sets a higher age for agreeing to terms like these). If you are under the age of majority where you live, a parent or guardian must agree to these terms on your behalf and is responsible for your use of the Game, including any purchase.

2. Your license

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play the Game on devices that you own or control, for your own non-commercial entertainment, in accordance with these terms and the usage rules of the app store you downloaded it from. The Game is licensed, not sold. We and our licensors keep every right not expressly granted here.

3. The free game and advertising

The complete Game is playable without paying anything. The free version is funded by advertising supplied by Google AdMob and its partners: a short interstitial advertisement before each next district, and an optional rewarded video that you may choose to watch in order to borrow thirty seconds after running out of time. Advertisements are chosen and delivered by the advertising provider, not by us; we do not endorse their content and are not responsible for it. Your choices about personalized advertising are described in the Privacy Policy.

4. Premium subscription

4.1 What Premium is

"Time Limit Premium" is an optional auto-renewing subscription with a period of one year. While it is active, the Game shows no advertisements and grants borrowed time after a failure immediately, without a rewarded video. Premium does not change the Game's difficulty, content or the limit of three borrows per district attempt. The free Game remains complete without it.

4.2 Price and billing

The price is shown in the Game and in your app store before you confirm the purchase (US$10 per year in the United States; equivalent local pricing elsewhere, as set by the store, which may include tax). Payment is charged to your Apple ID or Google account at confirmation of purchase. Apple or Google is the merchant of record; we do not receive or store your payment details.

4.3 Renewal and cancellation

The subscription renews automatically for the same period and price unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends. You can manage and cancel the subscription at any time in your store account settings (Settings › your name › Subscriptions on iOS; Google Play › Payments & subscriptions on Android). Cancellation takes effect at the end of the period already paid for; Premium stays active until then. Deleting the Game does not cancel the subscription.

4.4 Refunds

Refund requests are handled by the store you purchased from under its own refund policy, because the store processed the payment. We cannot issue refunds ourselves. Nothing in this section limits rights you have under consumer law, including any statutory right to withdraw.

4.5 Price changes and free trials

If we change the price, the store will notify you in advance and, where the store requires it, ask for your consent before the new price applies. The Game currently offers no free trial or introductory price; if one is added, its terms will be shown in the store listing and in the Game before purchase.

4.6 Restoring Premium

Premium is tied to the store account that bought it. After reinstalling or on a new device signed in to the same store account, open Premium from the main menu and choose Restore Purchases.

5. Seconds, badges and other virtual items

Seconds, borrowed time, upgrades, rescues, badges and anything else earned, borrowed or unlocked inside the Game are features of the Game, not property. They have no monetary value, cannot be redeemed for money or anything of value outside the Game, cannot be transferred between people or devices except through the store's own restore of Premium, and may change with updates. Borrowed time is a gameplay feature, not a credit, loan or financial product.

6. What you agree not to do

7. Updates, changes and ending the Game

We may update the Game to add or change content, fix problems or meet platform requirements, and some updates may be required to keep playing. We may also discontinue the Game or any feature of it. If we discontinue the Game while your Premium subscription is active, we will stop renewals, and you may be entitled to a refund of the unused part of the period from the store. We may end your license if you materially breach these terms. You may end it at any time by uninstalling the Game; this does not by itself cancel a subscription (see 4.3).

8. Intellectual property and feedback

The Game, including its code, art, text, characters, names, music and sound, is owned by us or our licensors and protected by copyright, trademark and other laws. "Time Limit" and "The Borrowed City" are our marks. If you send us ideas or suggestions about the Game, you agree that we may use them without any obligation to you.

9. Third-party services

The Game uses Google AdMob for advertising and Google's consent service in regions that require it, and the Apple App Store or Google Play for distribution and purchases. Those services are governed by their own terms and privacy policies. We are not responsible for them, and your use of them is at your own risk.

10. Warranties, liability and indemnity

Warranties. To the extent the law allows, the Game is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that it will be uninterrupted or error-free. Some jurisdictions do not allow these exclusions, so some may not apply to you. Nothing in these terms limits rights that consumer law gives you and that cannot be excluded.

Liability. To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or lost playing progress, arising from the Game. Our total liability for all claims relating to the Game is limited to the greater of the amount you paid us for the Game in the twelve months before the claim and US$20. These limits do not apply to liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Indemnity. You agree to compensate us for losses and reasonable legal costs arising from your breach of these terms or your unlawful use of the Game, to the extent the law allows.

11. Terms required by Apple

If you downloaded the Game from the Apple App Store, the following terms also apply, in addition to the rest of this agreement:

  1. Acknowledgement. This agreement is between you and us only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the Game and its content. Where these terms are less restrictive than or conflict with the Apple Media Services Terms and Conditions, those Apple terms prevail.
  2. Scope of license. The license granted to you is limited to a non-transferable license to use the Game on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the Game may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where available.
  3. Maintenance and support. We are solely responsible for providing any maintenance and support for the Game, as specified here or required by law. Apple has no obligation to furnish any maintenance or support services for the Game.
  4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Game to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the Game, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our sole responsibility.
  5. Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the Game or your possession and use of it, including product liability claims, any claim that the Game fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation, including in connection with the Game's use of the HealthKit and HomeKit frameworks (which it does not use).
  6. Intellectual property rights. In the event of any third-party claim that the Game or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of the claim.
  7. Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Developer name and address. Questions, complaints or claims about the Game should be directed to James Kaguo, P.O. Box 1802, Dodoma, Tanzania, jkaguo@gmail.com.
  9. Third-party terms. You must comply with applicable third-party terms when using the Game, including the terms of your wireless data service.
  10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this agreement. Upon your acceptance of these terms, Apple has the right, and is deemed to have accepted the right, to enforce this agreement against you as a third-party beneficiary.

12. Google Play

If you downloaded the Game from Google Play, the Google Play Terms of Service also apply to your download, and purchases and refunds are governed by Google Play's policies. Google is not a party to this agreement and is not responsible for the Game.

13. Governing law and disputes

These terms are governed by the laws of the United Republic of Tanzania, without regard to its conflict-of-law rules, and the courts of Dodoma, Tanzania have jurisdiction over any dispute, except that if you are a consumer in the European Union, the United Kingdom or another place whose law gives you the protection of your local courts and mandatory consumer law, you keep that protection. EU consumers may also use the European Commission's online dispute resolution platform. Before starting any formal proceeding, please contact us; most problems can be solved quickly by email.

14. General

We may change these terms when the Game changes. The effective date at the top changes with each version; material changes will be shown in the Game before they apply, and continuing to play after that means you accept them. If any part of these terms is found invalid, the rest stays in effect. These terms, with the Privacy Policy, are the whole agreement between you and us about the Game. You may not transfer this agreement; we may transfer it to a successor of the Game's business. Our failure to enforce a term is not a waiver of it.
